Probate is the legal process of estate administration if you die and have a will or die without a will or trust. The person named to act as the personal representative in the will handles the estate administration tasks, payment of taxes and debts, and distributes assets to heirs, only after the probate court accepts the original will to probate and the court authorizes the person named as the personal representative to act on behalf of the estate.
In most cases, the person named as the personal representative in the will has no experience with the administration of an estate, nor be able to prepare and file with the probate court the many legal documents required of the process.
